License In Review is NOT License Expired

February 13, 2020
Est read time: 1 minute
You've submitted your application renewal timely and have even received a biennial inspection from your local AHCA field office surveyor; however, despite your preparations, your license expired in the midst of the Agency's review.   Your insurance carrier and long term care plans are requesting, almost demanding, you to provide your updated license.

But what can you do?

You're still waiting on AHCA to go through their seemingly lengthy process to review and approve your application/survey.

If this happens to you, FALA wants to encourage you to not get overwhelmed. There are regulatory statutes that ensure the validity of the license during renewal; thus your long term care plans, liability insurance carriers, etc. may just need you to help educate them.

According to Section 408.806(2)(a), Florida Statutes, "...If the renewal application and fee are received prior to the license expiration date, the license shall not be deemed to have expired if the license expiration date occurs during the agency’s review of the renewal application."

Please contact our office if you have questions or need guidance in handling your long term care plans and other carriers.   Statutory Reference Section 408.806
